Does distancing between the Congregants Invalidate the Prayer? | Shaykh ʿAbdul Ḥamīd al-Ḥajūrī

Fatwā on the ruling of praying (in congregation) while maintaining distance in the rows between the congregants

Drawing close together within the rows in congregational prayer is from the specified affairs and I view it to be an obligation due to several evidences in this chapter and majority of the scholars have gone towards it being recommended and their opinion is the preferred one. That which attests to this is what has been narrated via an-Nu’mān bin Bashīr -May Allāh be pleased with him-:

The Prophet (ﷺ) said,

“Straighten your rows or Allāh will alter your faces.”

Agreed upon (Ṣaḥīḥ al-Bukhari 717, Ṣaḥīḥ Muslim 436)

Along with that, since the compulsory order has come upon the congregants to maintain distance within the rows, they are (left with a choice) between leaving off the congregation and Friday prayers and (offering congregational) Ṣalāh with distancing. So, I say, and with Allāh lies all success.

Congregational prayers while maintaining distance within the rows is better than leaving off the congregation and the evidence for this is in the saying of the Most High,

﴿فَاتَّقُوا اللَّهَ مَا اسْتَطَعْتُمْ﴾

“So keep your duty to Allah and fear Him as much as you can”

Surat At-Taghabun 16

And the Messenger of Allah (ﷺ) said,

“What I have ordered you [to do], do as much of it as you can.”

On the authority of Abū Hurayrah -May Allāh be pleased with him-, reported in Ṣaḥīḥ al-Bukhari 7288 and Ṣaḥīḥ Muslim 1337

And with regards to it being a prayer in seclusion behind the rows then from what is apparent to me, this is not the case and standing close together in the rows is obligatory (wājib) and not a condition (sharṭ) for the correctness of the Ṣalāh.

So I advice to attend the Friday prayer and the congregation and not to leave it off due to it not being attained in its complete form, as narrated from ʿImrān bin Ḥuṣayn, “I had piles, so I asked the Prophet (ﷺ) about the prayer. He said,

“Pray while standing and if you can’t, pray while sitting and if you cannot do even that, then pray lying on your side.”

Ṣaḥīḥ al-Bukhari 1117

And yes, drawing the rows close together in Ṣalāh is required, as per the legislation and intellect. But if one is incapable, then it is permissible to take the allowance based on the evidences for ability and strength and with Allāh lies all success.

So do not invalidate the prayer by severing the rows completely and this is from it, by Allāh’s will. As Shaykh al-Islām Ibn Taymiyyah -May Allāh’s mercy be upon him- said in his Majmū’ah:

“And in summary: So the distancing is not more necessary than (the requirements) other than it, so if the others are dropped due to an excuse in congregation, then it is more considerable of being dropped. And from the complete principles is that for the one who is legally incapacitated in Sharī’ah, the obligation is dropped. And the one who is under compulsion without sinning is not prohibited. So Allāh has not obligated that which his slave is incapable of, and has not prohibited that which he is forced to do.”

And this is from it -Allāh Willing-

And there is a difference between Ṣalāh by oneself alone behind the rows and a row which has a number of individuals but are interspersed. So the separation within the rows with the ability to join (the rows) is not allowed. And the one who does so intentionally is a sinner due to his opposition of the command of the Messenger of Allāh ﷺ. And it is permitted to pray between pillars due to necessity and it falls within the ruling of being a separator. But the speech regarding invalidation (of the congregational prayer) is in need of a clear proof in this affair and there is no such evidence. And Allāh knows best.

And there is some speech from the people of knowledge under this chapter, however I only intended a summarization.

🔵 (فتوى في حكم الصلاة مع التباعد بين المصلين في الصف)
الحمد لله رب العالمين والصلاة والسلام على رسوله الأمين أما بعد:
⬅️ فالتراص في الصفوف حال صلاة الجماعة من الأمور المتعينة وأرى وجوب ذلك لأدلة كثيرة في الباب وذهب جمهور العلماء إلى الاستحباب وقولهم مرجوح ويدل على ذلك ما جاء عن النعمان بن بشير رضي الله عنه: قال النبي صلى الله عليه وسلم : ” لتسون صفوفكم، أو ليخالفن الله بين وجوهكم “. متفق عليه.
⬅️ ومع ذلك حيث جاء الأمر الملزم للمصلين بالتباعد في الصفوف وهم بين ترك الجمع والجماعة أو بين الصلاة مع التباعد فأقول وبالله التوفيق.
⬅️ صلاة الجماعة مع التباعد في الصف خير من ترك الجماعة دليل ذلك في قوله تعالى: (فاتقوا الله ما استطعتم) ويقول رسول الله صلى الله عليه وسلم(ما أمرتكم به فاتوا منه ما استطعتم) وأما أنها صلاة منفرد خلف الصف فالذي يظهر لي أنها ليست كذلك و التراص في الصفوف واجب وليس بشرط في صحة الصلاة
⬅️ فانصح بشهود الجمعة و الجماعة وما لا يدرك كله لا يترك جله فعن عمران بن حصين رضي الله عنه، قال : كانت بي بواسير فسألت النبي صلى الله عليه وسلم عن الصلاة فقال : ” صل قائما، فإن لم تستطع فقاعدا، فإن لم تستطع فعلى جنب “. أخرجه البخاري (1117)
⬅️ ونعم تراص ‎الصفوف في الصلاة مطلوب شرعا وعقلا لكن إن عجز الإنسان فيجوز له الترخص بأدلة الاستطاعة والقدرة وبالله التوفيق.
⬅️ ولا تبطل الصلاة بقطع صف مطلقا وهذا منها إن شاء الله تعالى قال شيخ الإسلام ابن تيمية رحمه الله كما في المجموع:
وفي الجملة: فليست المصافة أوجب من غيرها، فإذا سقط غيرها للعذر في الجماعة فهي أولى بالسقوط. ومن الأصول الكلية أن المعجوز عنه في الشرع ساقط الوجوب، وأن المضطر إليه بلا معصية غير محظور، فلم يوجب الله ما يعجز عنه العبد، ولم يحرم ما يضطر إليه العبد. اهـ.
وهذا منها إن شاء الله تعالى.
⬅️ وهناك فرق بين صلاة الفرد خلف الصف وصف فيه عدة أشخاص ولكنه منقطع فتقطيع الصفوف مع القدرة لا يجوز ومتعمده آثم لمخالفته أمر رسول الله صلى الله عليه وسلم ويجوز الصلاة بين السواري للحاجة وهو في حكم المنقطع لكن القول بالبطلان يحتاج إلى دليل صريح في المسألة ولا دليل هنا والله أعلم.
وهنالك أقوال لأهل العلم في الباب ولكن أردت الاختصار فقط.
